A BILL


IN THE COUNCIL OF THE DISTRICT OF COLUMBIA


To amend the Autonomous Vehicle Act of 2012 to expand the types of autonomous vehicles that may operate in the District.

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this Act may be cited as the "Autonomous Vehicle Amendment Act of 2018".


Sec. 2. Section 3 of the Autonomous Vehicle Act of 2012, effective April 23, 2013 (D.C. Law 19-278; D.C. Official Code § 50-2352), is amended as follows:


(a) The existing text is designated as subsection (a).


(b) New subsections (b) and © are added to read as follows:


"(b) Notwithstanding subsection (a)(2) of this section, the Mayor may authorize an autonomous vehicle to operate on a public roadway without a driver seated in a control seat, so long as there is an individual capable of taking immediate control of the vehicle.


"© Notwithstanding subsection (a)(3) of this section, the Mayor may authorize an autonomous vehicle to operate on a public roadway with equipment that does not fully comply with the requirements of the Federal Motor Vehicle Safety Standards ("Standards"), if the National Highway Traffic Safety Administration has granted the autonomous vehicle an exemption from compliance with the relevant provision(s) of the Standards.".


Sec. 3. Fiscal impact statement.


The Council adopts the fiscal impact statement in the committee report as the fiscal impact statement required by section 4a of the General Legislative Procedures Act of 1975, approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).


Sec. 4. Effective date.


This act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto), a 30-day period of Congressional review as provided in section 602©(1) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Official Code § 1-206.02©(1)), and publication in the District of Columbia Register.
