Drunk Drivers

There has been discussion that one of the benefits of AV Technology will be safe transport of individuals who have been drinking.  When and how will the law allow even a fully automated vehicle to be "driven" by someone who is under the influence?

On a basic level, it seems any laws pertaining to drunk drivers operating autonomous vehicles will be tied to the level of autonomy of the vehicle. As long as cars are only semi-autonomous, drunk drivers will likely not be able to "drive" them legally:
